TERMS AND CONDITIONS

When you book a travel product and/or service with DestiWorld through a Travel Agent, you are agreeing to these Terms and Conditions as outlined. Payment for your reservation constitutes acceptance of these terms. Terms and Conditions are subject to change at any time.

If you booked through a contracted group, special Terms and Conditions apply in accordance with the group's contract. Please consult your Travel Agent for policies, procedures, and terms specific to the group contract.

1. BOOKINGS, DEPOSITS & PAYMENTS

All pricing is stated in US dollars. For packages that include airfare, pricing will include applicable airfare taxes, except for some destinations' departure tax. Other tour services and accommodations are included in your package price only if they are indicated on your itinerary. These package inclusions/rates are based on inclusions/prices at time of purchase and are subject to change without notice. You may incur additional expenses that are not included in the package price, including but not limited to resort fees, destination taxes and environmental fees.

If you are purchasing an air-inclusive vacation and are considering the purchase of a Basic Economy airfare, please note this is a nonrefundable fare. Changes, upgrades, and seat selection are not available on these fares. Additional limitations and restrictions may apply. We highly recommend reviewing the airline's policies and terms for these fares prior to purchase. Please note that the purchase of the Cancel For Any Reason Travel Protection will not cover Basic Economy fares.

Pricing and room inventory are not guaranteed until a reservation is secured with a payment. See the payment chart for a schedule of deposit dates and final payments. We reserve the right to treat the booking as canceled by you if the balance is not paid when due and applicable penalties will be applied.

2. CANCEL FOR ANY REASON TRAVEL PROTECTION

We strongly recommend that you purchase Cancel for Any Reason Travel Protection (CFAR) to cover your cancellation and change fees as well as post-departure insurance. CFAR may only be added within 7 days of your initial deposit and must be paid in full the same day it is added if 46+ days from departure. Inside of 45 days, CFAR must be added and paid in full the same day as booking. CFAR is non-refundable and non-transferrable from the moment of purchase. Please read through the coverage details of the policy you purchased as some services, such as nonrefundable hotels, are not covered by the Pre-Departure Cancel for Any Reason Waiver.

3. CHANGES & CANCELLATIONS

You must immediately notify your travel agent to cancel your vacation package. Cancellation must be received by DestiWorld a minimum of 3 hours prior to the originally scheduled departure time as indicated in your travel documents or no later than noon EST the day of departure for hotel-only bookings. If you are departing within 24 hours or over the weekend, you must cancel your airline ticket directly with the airline and you must contact DestiWorld at the During Travel Line provided on your travel documents to cancel the land portion of your travel. Failure to do so may result in a loss of the value of the airline ticket and nullify your right to a credit or refund under the applicable if applicable.

If you cancel your vacation or change your travel dates, flight, duration, class of service, name, departure city, or destination, the charges shown below become payable by you and may result in a re-pricing of your reservation. Significant additional penalties may apply to specific products, such as nonrefundable airline tickets and/or nonrefundable hotel promotional rates. If the number of individuals occupying a room changes, the remaining traveler(s) will be responsible for any additional costs incurred as a result of a change in the per-person occupancy rate. Once travel has begun, there will be no refunds for any unused or partially used travel component for any reason. Many airfares and hotel reservations are nonrefundable and nontransferable and may be subject to 100% cancellation/change penalties at the time of booking. Changes to, or cancellation of, a Basic Economy flight will result in forfeiture of tickets.

*Each airline carrier has different rules regarding cancellation and rebooking travel. We strongly recommend contacting the airline immediately to ensure you have the most updated information. Please ensure you thoroughly review the class of service being booked.

4. REFUNDS

Cancellations with Cancel for Any Reason Travel Protection (CFAR)

If you cancel your vacation, fees will be waived, and the amount due (less the cost of the CFAR) will be a refund back to the original form of payment OR in the form of travel credit depending on the date of cancellation. Please review the links provided in section 2. CANCEL FOR ANY REASON TRAVEL PROTECTION for details regarding coverage and refund vs credit eligibility.

Cancellations with Cash Back Cancel for Any Reason Travel Protection (CFAR)

If you cancel your vacation, fees will be waived, and the amount due (less the cost of the CFAR) will be a cash refund back to the original form of payment. Please review the links provided in section 2. CANCEL FOR ANY REASON TRAVEL PROTECTION for details regarding coverage and refund vs credit eligibility.

Cancellations with Future Travel Credit Cancel for Any Reason Travel Protection (CFAR)

If you cancel your vacation, fees will be waived, and the amount due (less the cost of the CFAR) will be a refund in the form of travel credit. Please review the links provided in section 2. CANCEL FOR ANY REASON TRAVEL PROTECTION for details regarding coverage and refund vs credit eligibility.

Cancellations without Cancel for Any Reason Travel Protection (CFAR)

If you cancel your vacation package, any refund due on the air-inclusive portion will be in the form of a travel credit less applicable penalties and fees. Please note any credit for the airfare is with the specific airline booked and will be subject to airline terms, policies, and rebooking conditions. Any refund due for land-only bookings canceled 8+ days prior to departure will be processed back to the original form of payment less applicable penalties and fees. Any refund due for land-only bookings canceled 7 or less days prior to departure will be in the form of travel credit less applicable penalties and fees.

5. GROUPS

If you are traveling as part of a contracted group, different deposit, payment, and cancellation policies apply. Please contact your Travel Agent for the detailed terms under the group contract.

6. CREDIT CARD TRANSACTIONS & CHARGEBACKS

If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies with the provider, and not with DestiWorld. In the event that payment has been made to DestiWorld by credit card, you agree that you will not seek to charge back your payment to DestiWorld. If DestiWorld incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company, you agree that you will be liable for these costs.

7. TRAVEL DOCUMENTS

Your travel documents will be emailed to your travel agent once full payment is received. Once you have received your documents from your Travel Agent, please check them carefully to ensure that all the information is correct and passenger names exactly match your Proof of Citizenship. If you discover an error, please contact your travel agent immediately.

8. AIRCRAFT AND FLIGHT TIMES

Flight times are not guaranteed and are subject to change. It is your responsibility to confirm your flight time with your carrier. DestiWorld does not accept responsibility for lost wages, missed vacation time or any other additional expenses incurred as a result of changes in flight times or flight cancellations.

9. REQUIRED DOCUMENTATION

Proper documentation is YOUR responsibility. The following information is based on current requirements for U.S. citizens at time of publication. This information may change- see your travel agent or contact your destination consulate for the most current requirements on your travel date.

Passengers returning to the U.S. by air from any international destination must have a valid passport and may be denied boarding by the airline if the passport is damaged, mutilated, or has excessive wear. A “Passport Card” is not acceptable. If your name on your passport (or for non-U.S. citizens, “valid travel documents”) does not match your name on your travel documentation, you will not be allowed to travel. A passport valid for up to 6 months past the date of completed travel is required when traveling internationally. Married or divorced women traveling under names other than what is printed on their travel documents must supply a marriage license and/or divorce decree. For details on how to obtain a passport, contact your local courthouse or post office. If you are not a U.S. citizen, contact your destination’s consulate or embassy to determine required entry documents.

Any passenger who is denied boarding due to lack of proper documentation will have their vacation cancelled. Failure to comply with the above requirements will result in you not being allowed to travel and no refund will be given. Cancel for Any Reason Travel Protection does not cover the instance above.

10. TRAVELING MINORS

We cannot accept unaccompanied minors under 18 for any travel. For certain countries, a notarized consent from both parents or legal guardian(s) is required for children younger than 18 years old traveling with one parent, or in someone else’s custody; or a notarized birth certificate showing only one parent, a parent’s death certificate, or a court order of child custody MAY also be permissible. Be sure to check with your travel agent, inquire with your destination‘s consulate, or visit websites such as travel.state.gov, dhs.gov or iatatravelcentre.com. Some airlines may require documentation for children traveling without their legal guardian beyond what is mandated by the destination country- contact your airline directly for details.

11. HANDICAPPED SERVICES AND FACILITIES

Should you desire any special service or equipment to assist with a disability during your hotel stay, please let us know in advance so we can advise the resort. Although we will do our best to assist you, hotel services vary, and wheelchair accessible rooms may be requested but cannot be guaranteed. Please check hotels website for additional information on handicap services available.

Should you require special assistance or equipment with the airline/at the airport, please contact the airline/airport directly. Standards vary by property and country, may not be consistent with the standards required by the Americans With Disabilities Act, and are not within the control of DestiWorld.

12. SPECIAL REQUESTS

If you request special arrangements such as adjoining rooms/room locations, bedding requests, specific assistance or special meals, we will pass on your request to the vendor on your behalf. We cannot guarantee special requests unless otherwise stated.

13. DENIAL OF ENTRY

Certain countries may deny entry to travelers with even a minor criminal record, and if not a U.S. citizen, entry back into the U.S. Check with the U.S. Embassy and the embassy or consulate of the country being visited to ensure you can travel as planned. DestiWorld does not accept responsibility if you are denied entry and cancellation penalties apply. Cancel for Any Reason Travel Protection does not cover the instance above.

14. FLIGHTS & AIRPORT CHECK-IN

Your flight information will appear on the booking confirmation issued when you make your deposit, and on your electronic travel documents issued upon full payment. All flight times are subject to change without notice. We strongly suggest that you reconfirm exact flight times with the carrier 24 hours prior to departure and again before departing for the airport. Please be advised that we may provide your name, phone number and/or email address to third party suppliers such as air carriers to be used to advise passengers of irregular flight operations and disruptions.

For international flights, we recommend arriving at the airport at least three hours prior to your scheduled departure time to allow time to check in and get through Security. If you do not have pre-assigned seats and have seat preferences, we recommend that you arrive early as seats will be assigned upon check in based on availability. Pre-assigned seat selection is at the discretion of the air carrier and may require payment of an additional fee.

If you do not check in at the airport or gate at the required time, or do not possess proper documentation, you will be denied boarding and will not be eligible for a refund. Additionally, if you fail to check in for your flight without prior cancellation, you are considered a no-show and will not be eligible for a refund. Cancel for Any Reason Travel Protection does not cover the instances noted above.

If you select a Basic Economy airfare, please note this is a nonrefundable fare. Changes to your flights, upgrades, and seat selection are not available on these fares. Additional restrictions apply and we highly recommend reviewing the airline’s policies and terms for these fares prior to purchase.

15. LUGGAGE & PERSONAL PROPERTY

Many airlines charge fees for checked and/or carry-on bags. Fees vary and are set by each air carrier. Information on carrier baggage policy and fees, liability for lost, misconnected and damaged baggage or other personal property can be obtained through your travel agent, by contacting the air carrier directly, or by requesting them at the airport. Carry-on luggage is limited to one bag per person and must be small enough to fit beneath the seat in front of you. Excess/oversized baggage may be denied at check-in or subject to additional charges. DestiWorld accepts no liability for loss or damage to luggage and recommends a TSA approved lock. All lost or damaged luggage must be reported to an airline representative at the destination airport by the passenger before you leave the airport. Some airlines do not cover damage to soft-sided luggage.

16. HOTEL CHECK-IN AND CHECK-OUT CONDITIONS

Check-in time for most hotels is 3:00 pm and check-out time can be as early as 11:00 am, regardless of your arrival or departure times. Check-in policies differ by hotel and will therefore vary. Many hotels will offer hospitality areas for travelers who may be without their room for some time; however this arrangement is solely at the discretion of the hotel. Travelers who would like to make arrangements for a late check-out and baggage storage must arrange this service directly with the hotel. We do not accept responsibility for any inconvenience or loss arising from these types of arrangements. Some hotels may require you to leave a credit card imprint or cash deposit upon check-in to provide security for miscellaneous charges such as telephone calls.

17. RESPONSIBILITY & LIMITATION OF LIABILITY

We have taken all reasonable steps to ensure that proper arrangements have been made for your vacation. However, DestiWorld is not an agent of these independent travel providers, and we expressly disclaim any liability for their actions or omissions. DestiWorld acts only as a sales agent for any airline, hotel, transportation company, or other service provider named in your itinerary. Service providers reserve the right to refuse service to travelers at their sole discretion. DestiWorld assumes no liability for the acts of the service provider in refusing service.

DestiWorld assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions by suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under DestiWorld’s control. You agree to release DestiWorld from all claims arising out of anything covered by this paragraph. DestiWorld has no special knowledge regarding the financial condition of the suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of The Passenger’s destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release DestiWorld from all claims arising out of anything covered by this paragraph. You agree that the courts in Miami, Florida, will be the exclusive jurisdiction for all claims brought by you or DestiWorld and you hereby submit to the personal jurisdiction of those courts. You agree to present any claims against DestiWorld within 30 days after the services end and to file within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You will be liable for all of DestiWorld’s attorney costs if you are unsuccessful in any legal action against DestiWorld.

18. POST-VACATION CONCERNS

If you have a complaint while on vacation you must provide DestiWorld with a reasonable opportunity to rectify the issue during your vacation by promptly notifying your travel agent or contacting the During Travel number provided on your documents so that every effort to assist can be done while you are in travel. If the matter cannot be settled on the spot, you must submit your complaint in writing with receipts or supporting documents to your travel agent within 30 days of the completion of your vacation. Please understand that we cannot consider post-vacation submissions if you did not provide DestiWorld with a reasonable opportunity to assist you during your trip. We reserve the right to give any compensation due in the form of future travel credits.
